Can Employers Reject Your Summer Leave Request?
Short answer: yes. An employer in the UAE can refuse an annual leave request for a specific period. This is especially if there are genuine work requirements, such as staff shortages or operational needs. Now, this does not mean employers can prevent employees from taking their annual leave altogether. Companies need to manage leave schedules fairly while ensuring business operations continue smoothly.
So, Who Decides When You Take Annual Leave?
Under UAE employment law, annual leave dates are generally decided by the employer based on workplace requirements. Employers can schedule leave on a rotating basis among employees to ensure the smooth running of the business.
According to the Federal Decree Law on the Regulation of Employment Relations (the ‘UAE Employment Law’), employers can determine annual leave dates based on operational needs. This needs to be in agreement with employees. They can also rotate leave periods among staff members. Employers must also inform employees of their approved leave dates at least one month before the leave begins.

Can Your Employer Prevent You From Taking Your Annual Leave?
No, employers cannot indefinitely prevent employees from using their accumulated annual leave. Under Article 29(8) of the UAE Employment Law, an employer cannot stop an employee from taking their accrued annual leave for more than two years. But keep in mind, the only time they can prevent you from taking your leave is when the employee agrees to carry forward the leave. Alternatively, the employee may receive payment instead of taking leave, as per applicable regulations.
