UAE Government Makes 5 Major Changes To Family Law In The Country

Big changes are coming to marriage, divorce, and custody laws in the UAE! The UAE Cabinet, working with the Ministry of Justice, has introduced Federal Personal Status Law No. 41 of 2024, set to take effect on April 15, 2025. These updates aim to modernise personal status laws, making processes smoother and fairer for everyone. Come with me, and I’ll share all the important updates to UAE Family Law you need to know.

1. Women Can Get Married Without Approval From Male Guardian

A major shift in the law now allows women to marry without needing a guardian’s consent. However, if there’s more than a 30-year age gap between the couple and the woman has never been married before, judicial approval will still be required.

2. Faster And Fairer Divorce Process

Divorces will now move faster, with the arbitration process shortened from 90 days to 60 days. Husbands must officially document the divorce within 15 days, or their wives can claim financial compensation. When it comes to financial settlements, both spouses’ employment status will be considered. If the father is unable to provide financial support, mothers may be required to contribute – with the option to seek reimbursement later.

3. Equal Custody Rights And Travel Freedom

Both parents now have equal custody rights until the child turns 18, ensuring greater stability. Parents can also travel with their children for up to 60 days per year without needing special permissions. Additionally, children aged 15 and above will now have the right to choose which parent they want to live with.

5. Tougher Penalties For Child Neglect And Property Abuse

The UAE is cracking down on child neglect and property abuse, introducing stricter penalties. Offenders could face fines ranging from AED 5,000 to AED 10,000.

These updates mark a major step toward modernising family laws in the UAE, ensuring greater equality, efficiency, and protection for all residents.
